Electronic Evidence
Effective July 1, 2015, all evidentiary hearings/trials scheduled before the Honorable Joan A. Lloyd in Courtroom 1 in Louisville, Kentucky will require the use of the Electronic Presentation System. Counsel will be responsible for providing their own laptop, which must have a HDMI output. Counsel shall 14 days prior to the scheduled evidentiary hearing /trial notify the Court of the need for evidence presentation equipment and schedule with the Court training and familiarization with the evidence presentation system. Attendance at Hearings
Judge Lloyd requires in-person attendance of attorneys and witnesses at all trials and evidentiary hearings. Attendance at regularly-scheduled motion hours may be permitted by video conferencing within the Western District of Kentucky, using the Court's videconferencing equipment. Videoconferencing involves an appearance at either the Bowling Green or Louisville courthouse as these are the courthouses and equipment used for Judge Lloyd's cases - although in rare circumstances when staff is available and the Judge has permitted access, a party or attorney may appear at either the Owensboro or Paducah courthouses to participate in a hearing in a Louisville or Bowling Green case. The Court, however, is under no obligation to make special accommodations for any attorney or litigant who cannot attend a hearing in either Bowling Green or Louisville, or due to staffing and technical issues beyond the control of the Court, and Judge Lloyd does not permit video-conferencing from other government or private facilities or via use of personal software such as Zoom or other applications.
Chapter 13 Confirmation Hearings: Judge Lloyd holds confirmation hearings in all Chapter 13 cases in which she is the presiding Judge. A notice setting the confirmation hearing for a date after the Section 341 Meeting date will be issued separately from the 341 notice by the Court. Debtors and their counsel are required to attend all confirmation hearings.
Telephonic Appearances: Please be advised that Judge Lloyd's policy is not to allow telephonic appearances at ANY hearing, regardless of circumstances or reason for the request. The Court may consider a motion to continue or reschedule a hearing with cause. Requests made by phone or by filing for telephonic appearances may be terminated by entry, rejected/stricken, or returned to the filer without additional entry or notice in the case. All parties should assume unless they receive an Order or Notice rescheduling a hearing that the hearing will be held as scheduled on the record. This policy includes requests to appear by personally-owned apps such as Zoom and WhatsApp as the Court does not use these in any hearing (Section 341 Meetings held by the trustees are not Court hearings).
